In creating the business that drives this site, Tarry Towne Mall requires that all businesses in the mall are aware of certain terms and conditions that govern their continued presence in the mall.

The following words have "special" meaning in these terms and conditions:

A "business" that is invoiced by Tarry Towne Mall for supply of the setup, maintenance and support of an online presence.

The "collection" of web pages, images, scripts and documents that is owned by Tarry Towne Mall.

The "content" of an individual client within the Tarry Towne Mall site.

All software, web pages, photographs, documents and intellectual property (IP) related in any way to the Tarry Towne Mall site remain the sole property of Tarry Towne Mall. This includes, but is not limited to product photographs and descriptions created by Tarry Towne Mall for clients of Tarry Towne Mall. None of these items may be copied or reproduced without express written permission from Tarry Towne Mall.

The client is the owner of copyright in respect of all materials supplied and hereby indemnifies and keeps indemnified for the duration of this agreement Tarry Towne Mall against all claims, actions or demands for infringement of copyright or any other Intellectual property right in respect of the aforementioned materials supplied.

The client consents to the use by Tarry Towne Mall of all material supplied in full or in part for incorporation and display in the Tarry Towne Mall web site for the duration of the agreement. "NO" sexual content or pornography will be allowed. Sites who set up an account through PayPal with sexual content or pornography "will not" be refunded their money and "will not" be allowed to establish a presence at Tarry Towne Mall.

Definition – Indemnify:

• To save harmless; to secure against loss, hurt or damage; to insure
• To make restitution or compensation for, as for that which is lost; to make whole; to reimburse; to compensate

Credit Cards

Tarry Towne Mall will not collect credit card information from shoppers at a client's presence within the Tarry Towne Mall site. Tarry Towne Mall will only process transactions of credit card information from clients who are on a payment plan for their presence at Tarry Towne Mall which excludes links such as "Resources" and "Affiliates." Resources and affiliates are completely responsible for all business transactions that occur from their links on the Tarry Towne Mall site. The client is fully responsible for the security and accuracy of credit card details once they are passed to the client, and for any record keeping required by the banking or taxation systems.

Tarry Towne Mall places no obligation on clients to remain in a time-bound business partnership with Tarry Towne Mall. A client may, upon payment of all charges incurred to date, request to cease involvement with Tarry Towne Mall at any time.
